1. Acceptance

By accessing nucleoraskin.com (the "Site") or purchasing from NUCLEORA SKINCARE INC. ("NUCLEORA", "we", "us"), you agree to these Terms. If you do not agree, do not use the Site or place an order.

3. Products — cosmetics only

We sell cosmetic skincare products. Our products are intended solely for cosmetic use. They are not drugs, natural health products, or medical devices, and they are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on this Site constitutes medical advice. Consult a qualified healthcare provider for any health concern.

4. Waitlist and pre-launch

During the pre-launch phase, the Site may accept waitlist registrations only. Joining the waitlist does not create a purchase agreement, guarantee product availability, or lock in any price. We will notify waitlist members when the store opens.

5. Ordering and pricing

All prices are in Canadian dollars (CAD). The price displayed at checkout is the product price inclusive of any applicable discounts. Taxes are calculated and displayed at checkout before you confirm your order; no additional fees are added after that point (Canada-only orders; domestic shipping is free).

We reserve the right to refuse or cancel an order in the event of a pricing error, suspected fraud, or stock unavailability. If we cancel a paid order, we will issue a full refund to the original payment method.

6. Taxes

Applicable Canadian taxes (GST/HST and provincial sales taxes where registered) are added at checkout based on your shipping address. Tax rates are determined by the applicable federal and provincial legislation in force at the time of purchase; we do not guarantee that rates will remain unchanged. If we are not yet registered for a particular provincial tax, you remain responsible for any self-assessment obligation under the relevant provincial legislation.

7. Shipping

8. Returns and refunds

Our Return and Refund Policy at nucleoraskin.com/policies/refund-policy governs all returns. The key terms:

  • Unopened product may be returned within 30 days of delivery.
  • Opened product is accepted for safety or efficacy concerns with supporting photo evidence, within 60 days of delivery.
  • Refunds are issued to the original payment method within 5–7 business days of receiving the return.
  • Return shipping is at the customer's cost unless the return results from our error (wrong product, defective unit, or undelivered order).

Consumer rights under the Quebec Consumer Protection Act and applicable provincial consumer-protection legislation are not limited by this policy.

9. Intellectual property

The NUCLEORA name, wordmark, packaging designs, and all Site content are owned by NUCLEORA SKINCARE INC. or its licensors. You may not reproduce, distribute, or use them without our prior written permission.

10. Limitation of liability

To the fullest extent permitted by applicable law, NUCLEORA's total liability arising from or related to the Site or any product purchase is limited to the amount you paid for the specific product giving rise to the claim.

Nothing in these Terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot be excluded under the Business Practices and Consumer Protection Act (BC) or other applicable mandatory consumer- protection legislation.

11. Privacy

Our collection and use of your personal information is governed by our Privacy Policy at nucleoraskin.com/policies/privacy-policy, which complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Act respecting the protection of personal information in the private sector (Law 25).

12. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rules in your province, you agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the courts of British Columbia.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be communicated to registered account holders by email before they take effect. Continued use of the Site after a change constitutes acceptance of the revised Terms.
